TERMS OF SERVICE
CallnSurf reserves the right to suspend or cancel a customer's access to any or all services provided by CallnSurf when CallnSurf decides that the account has breached the Terms of Service.
BANDWIDTH AND SERVER USAGE POLICY
In rare cases CallnSurf may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, CallnSurf reserves the right to impose the High Resource User Policy for the consideration of all customers.
Bandwidth allowance is 2Gb per domain per month unless otherwise indicated and overages are charged at £20 per Gb per month. Amendments to bandwidth quotas need to be agreed prior to the 15th of the month to qualify that month for the increased allowance.
HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization. CallnSurf may implement the following policy to its sole discretion: When a website is found to be monopolising the resources available CallnSurf reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby CallnSurf continues hosting the website for an additional fee.
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although CallnSurf reserves the right to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given. In situations where the card number on file is declined CallnSurf will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, CallnSurf reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request. No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.
PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down CallnSurf runs a limited number of payment options.
Cash Payment at your doorstep: You get your account instantly on phone, next day our representative will collect money from your doorstep.
Credit / Debit Cards: CallnSurf accepts Mastercard, Visa (not Visa electron),This option is only available in some cases on request of a CallnSurf account.
CANCELLATION AND REFUNDS
CallnSurf reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes CallnSurf's Terms of Service a refund will not be issued in the event of a cancellation. If not entirely happy with the service provided by CallnSurf customers may cancel their order within 14 days from order date without reason. Any payment made will be returned within 30 days of cancellation. Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services that were offered as start-up incentives in the result of a cancellation. Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund unless CallnSurf cancels the service or in circumstances where CallnSurf is in breach a refund may be due.
INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold CallnSurf harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against CallnSurf, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless CallnSurf against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with CallnSurf's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from CallnSurf's server.
DISCLAIMER
CallnSurf reserves the right to revise its policies at any time. In conjunction with The Supply of Goods and Services Act 1982 CallnSurf will carry out its work with reasonable care and skill. If the service were not carried with the requisite level of care and skill, the customer would be entitled to seek reimbursement for damages suffered as a result of this.
STATUTORY RIGHTS
This does not affect your statutory rights as a consumer.
